Possible reasons for traffic ticket dismissal

On Behalf of | Nov 30, 2022 | Traffic Violations |

Having too many points on your Virginia driving record may make life difficult for you. If you receive enough points, the state may take your license for a while, making it difficult for you to hold down a job, transport your children around or what have you. However, in some cases, certain things have the potential to make a traffic ticket you receive invalid.

According to Drive Safely, there are many different reasons a traffic ticket may undergo dismissal. Some of these reasons are below.

The ticket lacks information or contains incorrect information

Sometimes, bad recordkeeping on a law enforcement official’s part may result in your traffic ticket undergoing dismissal. If your ticket is missing any necessary information, or if it contains inaccurate information such as a wrong name or license plate, it may make the ticket invalid.

The law enforcement officer does not show

In some cases, you may decide to fight your traffic citation in court. If the law enforcement officer who issued the ticket does not show up, then the court may decide to dismiss the ticket.

You complete a defensive driving course

Depending on the circumstances, it may help your case to complete a defensive driving course before showing up to court to fight your ticket. This demonstrates that you are taking a proactive approach to remedy your problematic driving behavior. It may result in a judge tossing out the ticket, but this is not a guarantee.

After receiving a traffic ticket, it is wise to sort through your options. If you decide not to plead guilty and accept the ticket, you need to act within a certain timeframe if you wish to fight it.
