What to do after a car accident in Virginia?

On Behalf of | Mar 17, 2026 | Motor Vehicle Accidents |

Being involved in a car collision is a scary experience. While the crash itself can happen in a split second, the physical and emotional trauma it can cause may last far longer. To ensure your safety, you need to take measures that can protect your rights and help you avoid legal repercussions.

Assess your condition and call 911

After the accident, try to stay calm and check yourself for any signs of cuts or trauma. If you have injuries, call 911 immediately to ask for medical support. Under Virginia law, you must report your crash to the police if it results in injury, death or significant property damage. Failure to comply with this can result in a Class 4 misdemeanor.

Notify the police

While waiting for the paramedics, call the police to inform them of what happened. Once they arrive at the scene, they will interview witnesses and gather vital information from you and the other driver.

Within 24 hours of completing the investigation, officers will forward an official crash report to the Virginia Department of Motor Vehicles. Since you participated in this report, you can request a copy by mail or in person.

By securing this documentation as evidence, you can strengthen the statements in your personal injury claim.

Exchange information

After you speak with the police, you need to exchange information with the other driver and take photos and videos of the scene from multiple angles. If you own a dashboard camera, it is best to transfer the footage to your computer and show it to your lawyer.

Seek medical care

To ensure that your condition does not worsen, you must go to the hospital to seek treatment for your injuries. Keep a copy of your medical records and bill invoices, as these will serve as vital references when you compute your claim’s compensation amount.

Inform your insurance provider

You must call your insurance company to inform them about the incident. Stick to the basic facts and do not downplay your condition or admit fault, as these statements may harm your case.

By gaining a better understanding of Virginia’s car accident laws and practicing the measures listed above, you can avoid legal consequences and file your claim effectively. This process not only helps protect your rights but also empowers you to seek compensation for your damages.
